1. Acceptance of Terms

By accessing and using the MV Debt Counselling website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on MV Debt Counselling's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modifying or copying the materials
• Using the materials for any commercial purpose or for any public display
• Attempting to decompile or reverse engineer any software contained on the website

5. Accuracy of Materials

The materials appearing on MV Debt Counselling's website could include technical, typographical, or photographic errors. MV Debt does not warrant that any of the materials on the website are accurate, complete, or current. MV Debt may make changes to the materials contained on the website at any time without notice.

MV Debt has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by MV Debt of the site. Use of any such linked website is at the user's own risk.

7. Modifications

MV Debt may revise these terms of service for the website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts located in Johannesburg, Gauteng.

9. Debt Counselling Services

When you engage MV Debt for debt counselling services:

• You must provide accurate and complete financial information
• You acknowledge that debt counselling outcomes depend on creditor cooperation
• You understand that debt counselling is not a guarantee of debt elimination
• You commit to adhering to your approved repayment plan
• You authorize MV Debt to communicate with creditors on your behalf
• You agree to maintain confidentiality regarding your personal financial information

10. Fees & Payment

By accepting our services, you agree that:

• Our fees are NCR-regulated and will be disclosed in writing
• Fees are integrated into your repayment plan
• You are responsible for adhering to your approved repayment schedule
• Failure to maintain payments may impact your debt counselling status
• You are responsible for any banking charges or penalties incurred

11. Representations & Warranties

You represent and warrant that:

• You are at least 18 years old
• All information provided is true and accurate
• You have the authority to enter into this agreement
• You are not prohibited by law from using our services
• You will use our services only for lawful purposes

12. Limitation of Liability

MV Debt's total liability under these terms shall not exceed the amount paid by you for services in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

13. Non-Compliance

If you fail to comply with any terms of this agreement, MV Debt may:

• Suspend or terminate your services
• Pursue legal action for breach of contract
• Report non-compliance to the National Credit Regulator
• Pursue recovery of outstanding amounts

14. Termination

Either party may terminate the service agreement at any time with written notice. Termination does not relieve you of outstanding obligations or payments due. Upon termination, all rights and licenses granted under this agreement cease immediately.

15. Confidentiality

Both parties agree to maintain the confidentiality of all information shared during the debt counselling process. This confidentiality does not extend to information required to be disclosed by law or court order.

16. Dispute Resolution

Any disputes arising from these terms shall be governed by South African law. You agree to attempt resolution through negotiation before pursuing legal action.

17. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and MV Debt regarding the use of our services and supersede all prior negotiations, representations, or agreements.
